The Management and Enforcement of Community-Based Sentences. A Practitioner's Guide
The management of offenders serving community-based sentences is governed and informed by law and policy contained in a variety of sources. The aim of this book is to pull together all such information into a single comprehensive resource which provides accurate and accessible guidance on the interpretation and application of the relevant legislation, legal precedent and policy guidance in the field.
The book will be an invaluable tool for those working with offenders serving community-based sentences and also for legal practitioners involved with enforcement proceedings and associated applications at all levels of the criminal justice system.
This unique book sets out the legislative basis of the various adult and youth community-based sentences currently available under the parallel statutory schemes of the Powers of Criminal Courts (Sentencing) Act 2000 and the Criminal Justice Act 2003. It also incorporates the most recent changes to the field as brought in by the Criminal Justice and Immigration Act 2008. It goes on to address legal and policy issues involved in managing offenders subject to such sentences, including specific sections on proceedings for breach, revocation and amendment, covering all aspects of the legal process from commencement to case resolution, including:
National Probation Service and Youth Justice Board National Standards and guidance on managing offenders in the community;
National Criminal Justice Board targets;
the legal basis for enforcement and other proceedings;
guidance on drafting the required legal documents, including applications, informations, summonses and warrants;
a detailed prosecution framework including information on relevant procedural and evidential issues and dealing with contested breach cases and applications
Appendices include up-to-date extracts of the core legislative provisions and policy guidance, process maps for breach, amendment and revocation applications and example templates for the associated legal documents.
