Unjust Enrichment and Public Law - A Comparative Study of England, France and the EU
The central aim of this book is to examine claims involving unjust enrichment and public bodies in France, England and the EU. The work begins by exploring the law as it now stands in England and Wales following cases such as those involving the Woolwich EBS and the IRC, the swaps transactions and Deutsche Morgan Grenfell.
The author argues that so far these cases have been viewed from either a public or private law perspective, whereas in fact both branches of the law are relevant, and that the courts ought not to lose sight of the public law issues when a claim is brought under the private law of unjust enrichment. Since there has been much discussion, in the context of such cases, of the relationship between the common law and civilian approaches to unjust enrichment, or enrichment without cause, the French approach is then considered in order to ascertain whether it holds any lessons for England. And finally, since it is evident that even domestic cases concerning public law illegality cannot be understood without an examination of cases where that illegality is provided, not by domestic public law, but by the law of the EU, the book also investigates the division of labour between the European and the domestic courts in such cases, exploring the extent to which the two relevant issues, public law and unjust enrichment, are defined in EU law, rather than being left to the domestic courts.
